Texas Eviction Laws: A Landlord Overview

Texas gives landlords two things almost no other state does: a notice period the lease can shorten, and a narrow statutory right to change the locks on a delinquent tenant. Both are real, both are widely misunderstood, and misusing either one is how Texas landlords end up owing money to a tenant who owed them money first.

Do Landlords Have to Pay Interest on Security Deposits?

In most states, no. In roughly a dozen states and a number of cities, yes, and the obligation usually comes bundled with rules about where the money has to be held and when the interest has to be paid out. Whether it applies to you depends on your state, sometimes your city, and sometimes the size of the building.

3 Day Notice vs 30 Day Notice: What Landlords Should Know

These two notices are not alternatives, and treating them as a choice is one of the most reliable ways to get an eviction dismissed. A three day notice demands something. A thirty day notice ends something. The situation determines which applies, and there is no discretion involved.

How Much Is a Security Deposit?

One month's rent is the common answer, and in a growing number of states it is now the legal maximum. Others allow one and a half or two months, and a handful set no cap at all. What your landlord can charge depends entirely on where the property sits, and the number that appears on the lease is not always the whole amount that counts.

Arizona Eviction Laws: A Landlord Guide

Arizona runs one of the fastest eviction processes in the country. The summons in a special detainer action is returnable between three and six days from issuance, and for the most serious breaches trial happens within three days of filing. That speed is real, and it is exactly why Arizona courts are unforgiving about notice defects.

Can a Landlord Break a Lease?

Not in the middle of a fixed term, not without a legal reason. A lease binds the landlord exactly as tightly as it binds the tenant, so wanting the unit back, wanting more rent, or selling the building are not reasons. If a landlord is pushing you out anyway, you have remedies, and some of them are worth real money.
